SERVICE AGREEMENT

1.         PARTIES

This Service Agreement is made between: 

The client and their Partner or Support person Undertaking the Your Online Birth Class

-and-

The Provider: Midwife Lauretta

2.         DURATION

This Service Agreement will commence from the time of purchase

3.         PURPOSE

3.1.      This Service Agreement is made to facilitate Midwife Lauretta to provide services (including relevant resources both hard copy and electronic) to the Clients.

4.         TERMS

4.1.      The service covered by this Service Agreement is:

4.1.1.   ‘Your Online Birth Class’  (the Service).

4.2.      Midwife Lauretta is excited to provide education to the Clients in the lead up to their birth including the Services, information and resources.

4.3.      The Client agrees that Midwife Lauretta is not the Client’s private midwife and is not a medical doctor and that Midwife Lauretta cannot provide medical advice to the Client.

4.4.      For the avoidance of doubt, the Client agrees that none of the information that Midwife Lauretta provides to the Client constitutes medical advice and that it is the Client’s responsibility to contact their medical care provider with respect to all and any medical questions or concerns related to the Client’s or their baby’s health or wellbeing or at all.

4.5.      The client agrees any resources shared as part of the class do not constitute medical advice and are for educational purposes only, they must be used as advised to ensure safety for both the client and baby.

4.6.      The Clients agree that Midwife Lauretta staff work part-time and are not on-call to the Client.

4.7.      The Clients agree to communicate with Midwife Lauretta via email.

4.8.      Midwife Lauretta will endeavour to respond to Client enquiries received by email within two business days.

5.         COSTS

5.1.      Midwife Lauretta agrees to provide the Clients with the Services and the Client agrees to pay the costs set out in this clause.

5.2.      The cost for the course ‘Your Online Birth Class’ is: $220.00

5.3.      The Client agrees to pay the Costs in full at time of booking

5.4.       PAYMENT & ACCESS

              The Client shall pay the agreed-upon fee as stated in the payment invoice before gaining access to the Course. Once payment is received, the Provider will grant the Client access to the Course for a period of 1 year, starting from the date of payment confirmation.

6. CLIENT RESPONSIBILITIES

The Client agrees to:

6.1.       Complete the Course activities and assignments in a timely manner to gain maximum benefit from the Course.

6.2.         Notify the Provider of any technical issues or difficulties accessing the Course platform promptly.

TERMINATION

7.1.         Either party may terminate this Agreement at any time if the other party breaches any of its obligations under this Agreement. In case of termination, the Client shall not be entitled to a refund for the Course fee.

8.         LIMITATION OF LIABILITY

8.1.         The Provider shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the online course, whether based on contract, tort, or any other legal theory.

9.         PRIVACY

9.1.      In accessing any personal or relevant health information, Midwife Lauretta will comply with the requirements of relevant privacy legislation, including the Commonwealth Privacy Act 1988 (Cth), Private Amendment (Privacy Sector) Act 2000, Victorian Privacy Legislation, and the Health Records Act 2001.

9.2.      Midwife Lauretta understands that the Client’s written permission must be obtained for recording of the Services (photographs, video recordings or audio recordings, feedback or testimonials) and for distribution, including posting on social media and sharing by email.  

10.       THIRD PARTY INFORMATION AND RESOURCES

10.1.    Where Midwife Lauretta provides or refers to resources maintained by other organisations the Client agrees that this does not amount to endorsement by Midwife Lauretta and agrees that Midwife Lauretta does not accept responsibility for the accuracy, ownership or quality of any information contained in those resources or any damage or loss whatsoever which arises where the Client relies upon those resources.

11.       INTELLECTUAL PROPERTY

The Course and all related materials provided by the Provider are protected by copyright and other intellectual property laws. The Client agrees the course contents and resources are for personal use only and they are not to reproduce, distribute, modify, or create derivative works of the Course materials without prior written consent from the Provider.

12.       ENTIRE AGREEMENT:

This Agreement constitutes the entire understanding between the parties concerning the subject matter hereof and supersedes all prior and contemporaneous agreements, whether oral or written.

The parties hereto have executed this Service Agreement as of the Effective Date.
